Nice Planet 6: Get Me Off This Planet.

Re: Nice Planet 6: Get Me Off This Planet.

In today's episode of "Stupid Laws", it is illegal in Garden City NY to wash your car on private property. In addition, any private property in public view is considered public domain. Why does this go in the Nice Planet thread? This asininity was actually enforced.

Assuming that the law truly states what the cop says it states, and we have no reason to think he's lying, it's a crummy law to no end. That said, read the comments section on the video and you're in for inordinate amounts of stupidity. People claiming 4th Amendment violations, others saying that the cops just want to hassle the guy, and then many vulgar variations on that theme. People in this country really have no idea how cops or their rights work in this country.

I'm offended. And I'm invoking my "right not to be offended." It's nice to see Barney Fife's grandson is carrying on the family tradition.

Talk to Barney's lieutenant. If a cop is given an order, he has to follow through on it so long as it's not illegal. Once the camera phone came out, that guy compelled the cop even further to act out his LT's orders for concern of being found out as having disobeyed said direct order. I don't blame the officers on the scene at all. Blame should be placed upon the city's politicians and the police brass.

I thought the consensus was that "just following orders" wasn't a valid defense anymore. But, point taken. So Barney's grandson has been promoted.

High school kid gives teacher a hug. . .and is suspended for a year for "sexual harassment." Check out the video. It certainly looks like they went to Defcon 1 prematurely.

That depends if the actions are legal or not, a human rights violation or not. The officer's actions were entirely legal, he was just sent to enforce a stupid law.

Should I send you an Old Pio Decoder? You seem to have missed the fact that I agreed with you. Or is it "use it or lose it" for clichés?

I'll disagree. She neither met nor returned the hug, but in fact pushed him away. If she had warned him before about hugging her, this is a very clear case of sexual harassment. If.

I think it's anything but a clear case of sexual harassment.

I have no idea how Georgia defines it, and the school might have some weak definition, but as a general rule for something to be sexual harassment you need:
1. inappropriate conduct of a sexual nature (request for sexual favors, sexual advances, something based on sex);
2. It has to be based on her sex
3. It has to be sufficiently pervasive or severe to create a hostile environment.

Instances like this one almost always fail on 1 and 3. Unless this kid is grabbing her constantly, or unless there is something sexual going on that we don't see in that video, probably doesn't came anywhere close to conduct typically described as sexual harassment.

No doubt the school has some b.s., zero tolerance policy dealing with contact between kids and teachers that will result in this kid getting tossed. But to call it sexual harassment is a disservice to those people who really are subjected to sexual harassment.

Legal definition:

Unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature constitute sexual harassment when

submission to such conduct is made either explicitly or implicitly a term or condition of an individual's employment,
submission to or rejection of such conduct by an individual is used as the basis for employment decisions affecting such individuals, or
such conduct has the purpose or effect of unreasonably interfering with an individual's work performance or creating an intimidating, hostile, or offensive working environment.

Also "as a general rule"....don't touch people without their permission. Especially when they specifically ask you not to.

So the teacher is a frigid, fearful, over reactive b*tch. This kid has to pay for it by getting kicked out his senior year? There's no other punishment available? You actually approve of a totally subjective standard for these things? She didn't like it, therefore it's "sexual harassment?" Whether you intended it or not, that's the core argument of political correctness. By striving to avoid giving offense, we have empowered the most easily offended.

Speaking of being over-reactive and presumptuous...

That said, suspending the student for an entire year seems like overkill, unless there was more than one incident. I suspect we're not getting the whole story here.
