She doesn't get to decide whether it is a criminal complaint or not. In normal cases, she would file a police report and a district attorney would decide to press charges or not. This is not a normal case.
For criminal trials it is "beyond a reasonable doubt" for civil trials it is "a preponderance of the evidence." It is why OJ was found not guilty of criminal charges but was found responsible for two murders in civil court.
I'm inclined to give the woman the benefit of the doubt although if she does indeed have texts of him begging for forgiveness it would be nice if that came out. Regarding the Pats/NFL I'm not sure there's anything they can do at this point. Brown is entitled to due process like anybody else even if he is a self centered jerk. That changes if he's charged with anything, and I am a little confused as to why this is a civil suit instead of a criminal complaint.

IIRC, you don't have to prove as much guilt.
