But say I'm the CEO of Acme and Wile E. Coyote sues for negligence because he smashed into a mountain after using our giant bat costume. I've been CEO since 1991. It's now 2002 and we sold him the costume in 1999. To avoid being named in the lawsuit, I say I retired retroactively in 1999 so I'm not liable for anything that happened after that. Does that seem likely to fly? What if I filed my income taxes in 2000, 2001 and 2002 and listed myself as CEO of Acme Enterprises? Does that present a legal problem for me?
In the Federal Government it was (is) know as RIP -- Retire In Place.
