Definitely need changes when it takes 2 years for a frivolous suit to go to trial and then another 2 years for appeals. I'm not sure why the appeals court decided to hear the $54million dollar pants, when it shoul have been thrown out with prejudice.

And you're clearly not a lawyer, you just play one on TV.

Not to mention tort reform generally really has nothing to do with medmal tort reform. The major reasons for the escalation in costs in each type are different.

I was always under the impression that the idea behind tort reform was to limit the monies awarded as punitive, not those used to directly to indemnify the plaintiff.

Sadly too many in the GOP are playing it that way with regard to malpractice. But there are huge punitive awards in a pharmaceutical tort.

The real costs in malpractice are the frivolous ones that aren't winnable but go to court anyway (costing thousands to defend) or are settled out of court, the higher insurance premiums to the doctors that result, and the cost being passed on to the consumer (albeit indirectly) over time.

That's because the attorney lobby gives bags of money to Obama and the Dems - *that* is why TORT is not part of the package.

TORT reform is not part of the package because the GOP hasn't made any serious effort to flesh out a bill and have it vetted by the CBO. Had they done so, and negotiated in good faith, maybe it would be included, as the President is on record as wanting to take a look at the issue. However, when its thrown in at the end of the process, its easy to see that's being used either as 1) a delay tactic, or 2) a talking point for GOP candidates.

So I'll ask: what exactly is the proposal, endorsed by the whole Republican Congress, not just 10 of them, to enact TORT reform and how much (by a CBO analysis which they have access to and which the Dems have submitted their plans to) would this plan save?

Because anything they bring up, gets shot down faster than a clay target at a skeet match.

They could still put together a bill and propose it. If nothing else they could propose it by funneling it to the media. The minor party is never powerless.

They have plenty of power, if not to legislate, then to influence. The problem in this case is they don't want to offend their donors. That's fine, but don't pretend it's anything else. They're stonewalling, period.

Can I repeat the civics lesson? When the one man fillibuster was voted away, the minority party lost all influence on the legislative process when the majority party has 60 votes in the Senate and a solid majority in the House. Currently, as long as Bob Byrd is still breathing and can make it to the Senate floor, and all the Dems vote the party line, the majority can do what it wants, when it wants, and in any way it wants to.

I think that implies a grossly inflated view of the role and influence of political parties. It might be accurate for some countries, but not the U.S.

The current administration is really a function of the previous admin's actions. The election just served notice that people felt they were made fools of in '04.

We don't pay for anything, we just borrow and spend. Really we won't pay a lot on this, but our kids and their kids will.

This is why the next time Repubs are in charge (and it will happen) they should try to avoid being so vile in so many ways.
