Does the law treat dead by 5 mph over differently than dead by 50 mph over? Should it?

Yes, because good luck getting a jury to believe that going 5 over constitutes reckless driving when everyone on the farking planet does it.

This part is true. 15 over is reckless in MN. An added charge, at minimum.

Kill someone, draw blood, over the limit (however arbitary), BANG on the spot.

If your spouse/parent/child/friend is killed/maimed by someone at .09/going 5 over/whatever... do you take pity on their soul?

Depending on their attitude, I'd probably forgive them. It'd be really tough, but I would.

Someone who was completely blitzed at .25 or doing 30-40 over...different story.
