One of my sibs, who is a retired PCP (and very liberal) is beginning to express optimism out loud that dump will get the boot this fall but worries whether Joe can keep it together long enough to 1) win and 2) assemble quality people around him who can help him govern.

Palin was just a concession to the fundies so he could win, not a choice to help him govern. Slap's comment was about governing, I believe.

As worded, the primary focus of the 22nd Amendment is on limiting individuals from being elected to the presidency more than twice. Due to this, several issues could be raised regarding the amendment's meaning and application, especially in relation to the 12th Amendment, ratified in 1804, which states, "But no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States".[SUP][24][/SUP] While it is clear that under the 12th Amendment the original constitutional qualifications of age, citizenship, and residency apply to both the president and vice president, it is unclear whether someone who is ineligible to be elected president could be elected vice president. Because of this apparent ambiguity, there may be a loophole in the 22nd Amendment whereby a two-term former president could be elected vice president and then succeed to the presidency as a result of the incumbent's death, resignation, or removal from office (or even succeed to the presidency from some other stated office in the presidential line of succession).[SUP][8][/SUP][SUP][25][/SUP]

The practical applicability of this distinction has not been tested, as no twice-elected president has ever been nominated for the vice presidency. During Hillary Clinton's 2016 presidential campaign, she jokingly said that she had considered naming her husband Bill Clinton (twice-elected to the presidency) as her vice presidential running mate, but had been advised it would be unconstitutional.[SUP][29][/SUP] Similarly, this constitutional ambiguity has allowed for speculation in 2020 about whether (twice-elected) former president Barack Obama was yet eligible to be vice president.[SUP][30][/SUP] Most likely, the constitutional question raised will remain unanswered unless the situation actually occurs.[SUP][1][/SUP]

The 22nd amendment speaks only to electing someone president. The 12th says if you are constitutionally ineligible to be president you can't be VEEP. But does the 22nd really make a 2 term president ineligible for more service? The text refers only to being elected more than twice or more than once if you served more than 2 years of another person's term. Elected to and serving as are not the same thing. The 22nd also does not specify how many years you can serve in the office, again only referring to being elected.
 
Look I am all for trolling but I think that is a stupid idea. The Dems need to thinking about the future not trying to dredge up old hatreds and arguments.
 
Plus there has to be some principle of jurisprudence where a strictly Fregian interpretation of the words of a legal code cannot be made to cancel or reverse the universally-agreed upon intended meaning. Like if the Congressional Record f-cks up and drops a "not" a statute outlawing child porn can't suddenly be made to mandate child porn.

Nobody disagrees that the intent of the 22nd was no more FDRs. An intent, BTW, which despite the fact I think FDR is the only great president since Lincoln I am 100% on board with because incumbency is too large an advantage in an age of legalized corporate bribery.

It's a stupid idea and a bad idea.
