That lady is cra-cra. She took documents over a period of 10+ years, made phone calls to “subjects of counterintelligence investigations” (aka foreign spies), then self-reported that she had the docs because she thought she was under surveillance (she wasn’t).

This is not how rational people act.

And Trump is sane and he did just about exactly the same thing. Jail term should be the same.

The judge in Florida already has seen how Donnie will lie to her because in his presentations to her when he was seeking the special master to go through the documents. His statements made to her then, about how cooperative he was being, how he was working with them to give the documents back when suddenly they just raided his place out of the blue, etc.,are completely at odds with what the government is alleging he did in this case.

Now, maybe she's so die hard in the bag for Donnie that she won't care how much he lied to her in the previous case, but lots of judges don't take kindly to that sort of thing.

Would anyone really be surprised if she finds a way to dismiss the charges citing some technicality?

Not at all. Which is why it's not a bad thing that he can also be charged in DC and well as New Jersey for the same thing.

But doing that would tell politicians that everything is free game, and that would really be sad. I'm not interested in becoming russia.

She isn't going to do that...and even if she did (which would likely end her career) it at best delays the inevitable.

From what I have heard, she can make a decision and it's not appealable nor could it be re-prosectuted (double jeopardy).

And it would take a pretty solid D control to impeach her off the bench.

That isn't how double jeopardy works.

Never go full Priceless.

Ok, so I may use the terms wrong, but watching the explanation on Legal Eagle, he presents a method where she could rule so that there's no penalty nor can it be appealed. Or recharged. I didn't catch the whole thing, but it sure seems possible that she makes a ruling where he gets off.

You're talking about a Rule 29 acquittal, which when done after the government rests but before the jury has reached a verdict both can't be appealed and precludes a new trial due to double jeopardy.

Thanks, and IIRC, the allowance of the lawyer notes will be a big part of a potential Rule 29 acquittal, since that need the evidence to be bad, right?

It's a certainty that dumpy's lawyers try to dismiss the lawyer-client evidence. But since he brought them into an illegal act, he kind of nullified it. And he was nice enough to put that into the public domain with the interviews.

Anyway, it's possible, even if unlikely, that she lets him off.

Yeah she can rule they didn't make their case after they rest but she can't do that just out of the blue when the trial starts otherwise jeopardy doesn't apply which was what it sounded like you were saying. If she made a ruling to not have a trial the DOJ would be allowed to resubmit to a Grand Jury.

And this is not something that happens very often if I understand right. It is a pretty extraordinary measure.

Cannon has played it by the book so far, even gave the DOJ the dates they wanted to move the trial along and not let it interfere with the Fulton County charges that are forthcoming. Judges don't like when they are overruled on appeal and she got prison raped in the September case. She isn't going to stick her neck out when the dumbass was caught on tape admitting to the crime.

Yeah that is a big friggin deal. If I am John Eastman I'm freaking out at my bar hearings right about now...

Mike Roman, the guy who delivered the fake elector votes to Pence on 1/6 and was Trumps Election Ops Director, is also meeting with Jack Smith.

Also the DOJ is asking for the trial for the documents case be delayed until December. They have 84 witnesses :^o
