The Power of the SCOTUS II: "Release the Kagan!"

Re: The Power of the SCOTUS II: "Release the Kagan!"

I expect more out of a stats man like you. If there's one paper at -10 and another at +10, and somebody starts one up at +11, the +10 paper doesn't suddenly get to claim the mantle of "moderate." Completely preposterous.

Between != middle.
Exactly. The Washington Times isn't "moderate" because it isn't *as* conservative as the Washington Examiner, any more than the New York Daily News is "moderate" because it isn't *as* liberal as the New York Times. (Or, for that matter, than the New York Post is "moderate" because it isn't *as* conservative as the Wall Street Journal.)

Re: The Power of the SCOTUS II: "Release the Kagan!"

Lynah... i know where the truth lies (at least in the regards of these papers)... what I'm saying is that 1) the truth doesn't matter, 2) if it doesn't matter then why shouldn't it be on my terms instead of theirs?

Why the lack of ambition? Why not call the Post socialist, the Times liberal, the Examiner moderate, and claim that the conservative space (as usual) is unoccupied by any media presence?

For the same reason that calling the Times moderate doesn't work. Because there are too many smart people here. You can engage in issue framing all you want, but if you're going to be crazy about it, you'll need an audience that's stupid. Like a daytime AM radio audience, for instance. There are waaaay too many college (and grad school) grads around to pull it off @ uscho.

because you can't tack that far without people noticing... besides, you also know that there's nothing that "conservative" at least in the American definition of conservative... at that point the word "conservative" fails and you start splintering into other ideologies.

Holy crap. Covington & Burling doesn't lose very often.

And a 9-0 rout, to boot. I read some of the oral argument a few months ago, and it sounded like the Court wasn't entirely buying the Appellant's arguments at that time.

Re: The Power of the SCOTUS II: "Release the Kagan!"

Man, their case must have sucked hardcore to get those 9 to agree on something.

Maybe the NFL thought they could just appeal this back to Goodell.

It's only losing if you don't get paid.

Does this decision undermine MLB's status?

True, but they're pretty tight with the NFL (have been ever since they gave Tagliabue to the NFL and maybe before). I'm sure they're not happy about it.

I'm also not sure how harmful the decision really is. I'm skeptical, but we'll see...

I was wondering the same thing. Honestly, I hope it doesn't. This is 100% SWAG at this point, but it probably has something to do with the CBA.

No. It probably should have, since the original exemption was based on an interpretation that hasn't been seen since the Great Depression, but it didn't. SCOTUS has said repeatedly they won't do it, either. It'll be up to Congress to remove it at this point.

The NFLPA is saying the decision will influence future labor agreements, while the NFL doesn't see it extending that far. As a practical matter, I think the NFL is probably closer to the truth at this point. And the anti-trust matter still has to go back for trial, so "it ain't over til it's over!". ;)

Good news! The SCOTUS has sided with the rich and powerful again. It was touch and go for awhile, but in the end, wealth won out.
Phew
