Why would she? Did she endorse Bush? I don't remember that.

I'm not comfortable with judges voicing their political opinions. Theoretically they should be as free as the rest of us as long as they maintain the proper etiquette. For example, if you're an employee of a company you never voice your opinion in your capacity as an employee of that company -- you separate yourself as a private individual speaking only for yourself. Networks put a proviso on their shows that statements voiced by people appearing on their shows are not their opinion. By extension it ought to be OK for RBG to say her thing if she's not in her robes or in chambers.

But I admit a double standard: I want justices to appear to be scrupulously neutral. If they want to have a couple drinks and mouth off at a cocktail party to a few guests, OK, fine. But not in an Op-Ed or into a mic. I don't think it should be in any way punishable -- that would be a cure worse than the disease -- but I do think justices should demur on political issues.
This is exactly right.

You know that judges, in the privacy of their chambers and in front of their staff, are ripping on politicians or the political issues of the day left and right. Fine.

But don't stick your maw in front of a microphone and spout off. Furthermore, the higher up the judicial food chain you go, the more circumspect you need to be. She knew better.

Agree, with caveat: Elected judges.

But life-time appointment judges? They have the cush job; but, with that comes needing to stay stoic.

RBG failed. And it seems unlike her. Honestly, she's so far afield from expected behavior of a Supreme jurist I'd offer her a chance at this.

Funny I didn't see you offering that to Scalia when he did the same freaking thing for practically the last half dozen years of his life.

RBG screwed up, but she's not mentally unsound.

I knew Scalia was off his pins when he was speaking in public - no filter between brain and mouth. He was best when he was deliberative (writing).

My prediction: After a long day at the Court (stressed, tired) I bet Scalia rolls a 28/30 on that, and RBG rolls a 27/30. We are talking about people here who otherwise would be living in independent (assisted?) living facilities. They are human.

OK...I'm not an attorney and I don't know that much of the particulars. But why is Tom Brady in front of the SCOTUS anyways. The NFL is the organization enforcing its own rules. Its a failure on their part...and the authorities there should be fired in any case. That's all.

You have a right to file a petition for cert. You don't have a right to have it granted. His will be one of the thousands that are denied without comment.

The Mini-Mental exam he linked to earlier. Basically a quick reference point for docs to check if a patient's cognitive ability may be slipping.

I've watched someone who I thought was guano-loco demented score a 30; I saw someone I thought was fine pop a 22. People with a high raw intelligence can cover mild cognitive impairment dementia in day-to-day interactions, but the test exposes it.

Scalia stopped hiring liberal law clerks, stopped reading the NY Times or Washington Post, and listened exclusively to talk radio on his commute in his later years. I'm not sure I'd agree that he'd score higher than RBG. He was already showing signs of old person-itis.

Go to any news source that covers the NFL and you'll find the story there.
I've seen nothing more than it's an option being weighed and there's been no decision whatsoever in regards to any appeal to the SC.
