Pro career - that's a stretch. The NCAA makes a big deal about the number of student-athletes that never play pro.

In their June 3 filing, Middlebury and Beaney seek to spin the events in a slightly different way than Knelman’s complaint did but, even in their retelling of the facts, the facts indicate that Beaney dismissed Knelman from the Middlebury hockey team on January 24 primarily for leaving a January 15 banquet for Middlebury hockey alumni a short time before the function officially ended. At various places in the document, Middlebury and Beaney argue that there were issues with regard to Knelman’s attitude prior to the banquet but they undercut this argument by admitting that the coaching staff had not previously communicated concerns about Knelman’s attitude to Knelman or other members of the team. And then Middlebury and Beaney basically acknowledge that Knelman had no internal recourse to obtain relief or review of Beaney’s actions against him.

To be simplistic about it, these facts are not particularly favorable for Middlebury or Beaney. Thus, we see signs in the answer that Middlebury and Beaney are likely to rely primarily on legal arguments as their defense—which in turn are likely to eventually emerge in the form of a “motion to dismiss” or a similar filing—and to try to avoid a jury trial that will require an assessment of the less-than-complimentary facts.

Discovery in this case began in August, with the exchange of “interrogatories” (written questions) and requests for production of documents. Through the documents production process, each of the parties can gain access to e-mails and other documents in the possession of the other side or persons associated with the other side that relate directly or indirectly to the case. For example, the discovery process will allow Knelman’s attorneys to dig into Middlebury’s and Beaney’s records with regard to why other Middlebury players mysteriously disappeared from Beaney-coached teams over the years (examples include the departures of quality players such Tim Schneider early in the 2003-04 season, James Guay midway through the 2004-05 season, Kyle Koziara in the 2006-07 season, and Mike Kretschmer after the 2008-09 season). On a more basic level, it will give Knelman the ability to gather e-mails and such about him that were written by the coaching staff, other players, or Middlebury administrators and faculty members.

Chaz Svoboda should be in there. Jerked around big time. One of the top scorers one year. Gone the next. Beany is a joke.

According to those 120 paragraphs it would seem as though Knelmann was treated unfairly, and that Beany has used this technique to perhaps "wake up the team" several times during his tenure. That type of coaching is old school, but has gone the way of the Dinosaur. It also seems like the kind of behavior that NESCAC schools specifically would rally against. That's some Dead Poet Society **** there...

However, we're only hearing one side of the story. Maybe there were other issues too? Midd was 4-5-3 with Knelmann and went 7-3-3 after he was dismissed. I wonder if something else occurred between those two the weekend of the Trinity tie and Wesleyen loss? Did Knelmann tell Beany that he had family coming to town when he asked how long the alumni banquet was going to last, or did he just ask how long it was going to take? Why didn't his dad just go to the banquet as well?

doncherry may well be right, or he could have ties to another NESCAC school that has done more than their fair share of losing to Beany coached Middlebury teams... ;)

Out of curiosity, if some players left the team for reasons related to grades, violations of school discipline/rules, etc, would documents related to those things be witheld?

FERPA certainly would apply. The extent of the information made to the legal teams and public will certainly fall into the hands of court. Redaction would likely be of little use given the small party size and the circumstances relating to the individuals (time frames, contributions, etc). And of course, there is the likelihood that some of the parties may grant consent.

I am not familar with the law as it pertains to this case but at first glance it would appear to be a matter of conduct by a college employee; something the administration should deal with if they determine there was a problem.

A lot of reasonable people would have Knelman missing a few games but not the rest of the season for skipping out on the banquet but am not familar with all the details. But it does seem like a little to much punishment for a young man who made a little mistake.

Nope. Svoboda family are good friends. Beany opened his mouth to people that he was going to cut the kid before the season began but did not tell Chaz so he could transfer or make other arrangements to play. Class act.Family never complained Btw..Funny ...Beany being sued and Chaz ( Charlie ) is playing Division l pro in Czech Republic. . Last laugh is sweet.

Can't wait see to Charlie Strauss, Martin Drolet and the rest of the Panthers in action at the Primelink. I am sure later on this month fans will be talking about Middlebury playing against teams that have had a lot more games under there belts, with all the other Primelink teams having played against top competition. However playing in the big rink at Middlebury will give the Panthers some advantage.

Moving onto the 2011-12 season. i noticed highly recruited robbie dobrowskie (sp?) isn't on the roster. anybody know what happened?

The roster is NOW out ... and he is on it.
