Only if he gets a majority of the vote. Right now Jeffries is getting a plurality, but not a majority. To get a majority, he'd either need to get additional votes, or have some representatives who are not voting for him now simply opt out of one of the future votes, thus lowering the number needed to get a majority.

Everyone votes. It's just the usually the majority all decide to vote for the same person and get a majority, making whatever the minority does moot.

The answer to the second question is yes. If there were GOP protest votes that crossed the aisle, a Dem could be speaker.
Sure - technically, the speaker doesn't even have to be a Member. Recall the "Trump for Speaker" nonsense from a year or so ago? Party has nothing to do with it.

If you have the votes you are Speaker. Party doesnt matter and as has been pointed out you don't even have to be in Congress to be Speaker.

So the Dems won but technically are the minority because they're needs to be 3 special elections in Dem areas due to resignations (new Lt. Gov and new House Member) and 1 death. The GOP attempted to prevent a Dem speaker because the hold a 101-99 lead until those elections. A GOPer nominated a Dem for Speaker. Tbe GOP nominated someone else. The Dem wins and promptly goes Independent because he said all of this is nuts and we need to go back to the way things used to be. Now the Penn House will be 101-101 after the special elections with a non-caucusing Independent as the tiebreaker with the gavel. That could be total chaos but it might kill the Qrazies in Penn because it's obvious the moderates are out to shut them up!

BTW McCarthy sent Capitol Police Chick-Fil-A as a thank you...they tossed it in the trash. That man killed his career when he flip flopped on his "Donald Trump Caused 1/6" opinion. Tbis is epic. Even if he somehow pulls this out (he isnt) he has no power or clout. He isn't even a puppet he is a cardboard cutout at best.
