POTUS 45.65: I'm Just Here For The Lincoln Project Ads

Man the GOP really thinks the "he declassified everything" mantra is going to stick...

As somebody in the biz: while classification authority derives from the President via every contractor's favorite Executive Order, EO12333, (pronounced "E O twelve triple three," now you too can be a bloodsucking tick on the American body politic; trust me, it is not worth dealing with the insolence of government staffers, particularly my wife),

1. There is a formal (and time-consuming) process with checks and receipts
2. It is unclear whether the President can declassify just any document, particularly special access program (SAP) documents
3. AND HE CAN'T AFTER HE LEAVES OFFICE!!!

There is nothing magical about being a former President. There are situations in which the intelligence community has permitted certain former presidents to retain certain documents for memoirs, as well as certain clearances for being briefed for new information to advise the sitting President. However, all of that is entirely at the discretion of the IC. The moment Biden was sworn in, Dump ceased to have any more authority to declassify any document than you do.

I've read that more chatter has popped up from the far right wing loons about civil war regarding the execution of a search warrant on the trump domicile. It won't be like your great(or great-great in some cases)grandfather's war between the states but prob more likened to the the attempted attack on the FBI office in Ohio.

Would you be shocked if after all this he walks away?? I wouldn't
If be more surprised if anything more consequential than a wrist slap happens to TFG. His henchmen, however, will have some severe legal bills (TFG’s are still being paid by the GOP) and a short bit of jail time.

These cosplayers really think they can take their semi-automatic AR-15s up against military hardware that goes BRRRRRRAAAAAAAAAAAAAAAAAAPPP?

Unless we're gonna be seeing more Timothy McVeigh copycats...

That would end the right to bear arms. Or at least get massive restrictions.

I worked from home for a little over a year in 2020 and during that time I went through all the steps to get a CCW license. I haven't purchased a firearm yet and hope the situation never arises that I have to.

Honestly, you're a responsible gun owner who I'd want to see take advantage of your right.

These Gravy Seals who think they're patriots are the ones that need to be kept in check.

I have had concealed carry permits in every state I have lived in for most of my adult life. (and thank you Ohio for becoming yet another state where any yahoo with the desire can now do so... morons) I have NEVER carried a weapon outside my home other than for transport or to a firing range/other private area to target shoot/practice. 4 or 5 years ago I began to question even the reasons I owned a firearm and considered relinquishing it (I also have only owned more than one for a very brief time, and then it was just 2 when transitioning from revolvers to semi-auto pistols). Now, I'm not so sure about ever getting rid of it, and have even considered I may someday feel like I need to carry it outside my home. Frankly, I hope I decide to get rid of it before I decide to do that.

My BIL, a sheriff’s deputy, only owns his department required sidearm, kept in a gun safe with a trigger lock to boot. He understands the data regarding gun ownership and likelihood of his children suffering more than any potential deterrence. He’s the one who cringes the most any time our FIL gets going about the [insert unnecessarily huge count] of guns he owns.

He isn't walking away, the point of all this was never to lock him up otherwise it would have been the FBI going public when they executed the search warrant. He made this a bigger deal than it was ever meant to be...

There is no chance this just goes away though.

From what I read if any of it is nuclear in nature he doesn't have the authority to do it anyways it has to go through someone else. Technically most declassifications have to be approved by a separate governing body to verify that the information is ok for public consumption but as you were basically saying, that becomes murky when it comes to the President. The intriguing thing a former general (may have been General Mark Hertling I forget) said was that even if he did declassify them while in office (the story is he did it with Kash Patel the last day as President...convenient) if it is not labelled correctly (i.e. changing the stamp on the document) then declassification doesn't matter anyways. As long as the docs say "Top Secret" they are still to be handled as such. No idea if that is true but that would be a hilarious technicality.

None of this matters, the classification just showed the severity of the things he stole. He wasn't supposed to have any of it anyways. He knew that as did his (most likely soon to be disbarred) lawyers. Just like every stupid scandal this piece of crap has he makes it way bigger than it needs to be by lying and changing the story.

The whole idea of having the President at the top of the chain is so that the authority ultimately is sourced back to a popularly elected civilian. It's about the sovereignty of the people, for whom the President holds power and responsibilities in the public trust. Dump OTOH viewed the Presidency like a property he owned (insofar as a single celled glob of rotting fat can be said to have any coherent views at all).

He and his conservative enablers have no concept of res publica. They simply think in terms of power and coercion, since that is their root being (and terror).

Conservatives are what you get when entitled people stop maturing (and learning) at 13 years old.

I thought it was only questioned (for non-nuclear) if the archivist disagrees with the destruction of the documents and then it goes to the appropriate senate committee. The President has ultimate classification power on non-nuke stuff. But it generally has to be timestamped and filed. It hasn't tested whether POTUS can just say "I declassify this" in an empty room and poof, it's declassified.

mark hertling had a great thread on this

I'm curious again from uno's perspective if this would get someone disbarred. I think viewing material they weren't allowed to see puts them more in criminal territory. But not sure they would get disbarred the way uno last described the rarity of it.

One thing to bear in mind wrt nuclear- the president does not have unilateral authority to launch, and imho, that non-unilateral position extends into the info area. There has to be no way that the president acting on his own can declassify nuclear weapon info, especially to pass on. That’s the kind of treason that is a capitol offense.

The problem both lawyers have (but especially Ms. Bobb) is they are going on TV accusing the DOJ of planting evidence and lying about how they were never allowed to be part of the search. She was there, she signed the warrant and the list of documents, she said what rooms they were in and where they searched (cause she witnessed it!) and saw that there was no way they could have planted anything. The fact she was at the Insurrection and was part of the attempted Elector Scheme is not helping her either.

I mean Christ one of his lawyers used to work for OAN.
