  • And then blew a 2-0 lead at the half (with one of the best counterattack goals I've ever seen to make it 2-0) against Brazil in the final....

Last is another malicious prosecution-type case. Per curium decision saying the circuit court applied a wrong standard. Lots of concurring opinions. Thomas dissents.

More tomorrow. Lots of major ones still outstanding.

Next is a decision by Thomas regarding expert testimony standards. 6-3, with Gorsuch, Sotomayor and Kagan dissenting. There will be at least one more.

Next is a malicious prosecution case. 6-3 by Kagan. The existence of a legitimately charged crime does not inherently bar a claim for malicious prosecution for a baseless charge made at the same time.

    Thomas, Alito, and Gorsuch dissent.

1st today is Moore by Kavanaugh - 7-2 on the outcome - 5-2-2 on the reasoning (majority was Kavanaugh+liberals+Roberts, Barrett concurred joined by Alito, Thomas and Gorsuch dissented). Congress can tax foreign unrealized, unrepatriated gains.

Thomas and Gorsuch dissent, saying Congress...

I get that, and I understand licensing in all forms, whether a driver's license, a bar license, a medical license, or whatever, is a marker of minimum competence and not proficiency. I guess for me I'd probably set that bar of minimum competence a little higher in this case.

    Then again,...

  • Juries are very, very rarely sequestered. 99.9% of the time they're just admonished to not watch or read the news. Otherwise they return home and go about their normal lives when they aren't in court. Also why most trials only go 4 days per week....

  • Because everywhere in Iowa outside of 3 cities (Des Moines, Cedar Rapids, Quad Cities) and the 3 college towns (Iowa City, Ames, Cedar Falls) has gone full derp - Iowa was one of two states (the other being Florida) that had the red wave in the 2022 midterms that every other state avoided. Also, the...

To the extent we can try to guess majority opinion authors by who hasn't written for given sitting:

Rahimi - Only one left from November - Roberts, Alito, Kagan, and Sotomayor all are options. Guessing this is Kagan, as Sotomayor would've had it out already. Possibly Roberts if he was needed...

As we close in on the end of the term, there are still some big ones sitting in the wings:
Rahimi, can domestic abusers be banned from obtaining firearms
SEC, how much independence/powers do administrative agencies and administrative law judges have
Moore, is a tax on unrealized gains...

  • You almost have to assume the "max drop rate" lasted a mere fraction of a second, because the plane wouldn't just drop and then climb instantaneously. When the plan bottomed out at 400 feet, it would've been pulling up and out of the dive/descent, so the point of maximum drop rate had to have...

Honestly, it's a bit absurd that I will now get my M-class endorsement on my license after having been on a motorcycle for all of 10 hours, and that's being extremely generous counting all of the hours on the parking lot portion of the class. Take out the demonstration and instruction time and just...

  • So it dropped 200 feet at a rate of 4,000 feet per minute. 200 feet/4000 feet/minute = 2/40 = 1/20 of a minute * 60 seconds/ minute = 3 seconds, assuming the entire drop was at that rate. If you assume the max drop rate was only a blip before it was corrected, you're probably still only looking at a...

So at the suggestion of my better half to not wait until the heat of summer to take the MSF basic skills class, still had the itch by Memorial Day so signed up and ended up doing it this weekend.

Yeah, definitely going to keep doing it. Will probably spend most of this summer just riding...

  • I'm not blaming video game culture, Lord knows I played my share of Quake, Team Fortess, and the like back in the day. I'm saying that self-described "gamers" are a particularly misogynistic sub-culture, and I think that particular group is growing.

    Maybe it's just they're more...

  • Difference is the things you mention are for needs and geeks. We're not taking about the kids playing the latest Civilization game or Final Fantasy game, but the average Call of Duty or FIFA or Fortnight player, where if you turn on the in game speech 10 year-olds are saying things that would make sailors...
