i dont agree with either interpretation, but atleast they are consistent that your yard/driveway is not your home. of course i assume that means we should all get federal funds to maintain those places since we dont own them!

Surprising as hell the 9th Circuit would rule in favor of the feds on this one. Even the FBI needs a FISA warrant to wiretap potential terrorists or read their emails. I can't see why GPS would not require a warrant. Unless Congress acts first, the Supremes will probably step in. And then it's anyone's guess how they'll rule.

The last time they stepped in, didn't they unanimously uphold stopping in the name of love? (Or was it a motion to find out where their love went?) Seems like that could be the sort of precident that would leave them upholding this as well. In fact, I fully expect them to second that emotion.

That would wonderful, but nothing leads me to believe Roberts is anything but a cheerleader for this sort of stuff. The biggest disappointment on the current Court is the guy who self-advertised as a neutral "umpire" is turning out to be just another assertive ideologue like Alito, Scalia and, on even-numbered days, Thomas. That means Law Enforcement 5 Civil Liberties 4.
