      The legislative alternative is for Maine to make the vouchers only available to other public schools and eliminate their ability to be used for any private school. Not sure how likely they would be to do that.

        Carson came out today, but none of the other 4 were major. So 13 left, including all the other major ones. next opinions coming Thursday.

          I think that claim by her is a bit over the top, for what was done.

          The dissent would basically take the position that there can be zero public dollars, ever, in any way, flowing to a church or religious organization, because doing so establishes a religion in violation of the constitution. I don't think that's true.

          For instance, if a municipal utility offers a rebate check for any property owner that installs an energy efficient furnace, must all churches and church schools be forbidden from participating because doing so would establish a religion? No way.

          That's what happened in Maine. Maine has school districts where it has no schools (seems like a very Maine thing to do). So Maine law says that students in those districts can choose any school they'd like to attend, and their home district will then pay for it. The school just has to be accredited.

          But, oh by the way, schools with religious affiliations need not apply, even though they are accredited.

          Letting the student choose that school and having district money go to it, as opposed to some other school, isn't establishing any religion.
          That community is already in the process of dissolution where each man begins to eye his neighbor as a possible enemy, where non-conformity with the accepted creed, political as well as religious, is a mark of disaffection; where denunciation, without specification or backing, takes the place of evidence; where orthodoxy chokes freedom of dissent; where faith in the eventual supremacy of reason has become so timid that we dare not enter our convictions in the open lists, to win or lose.

                i don’t think sotomayor is being hysterical here. We all know the right will just continue to bring cases to the Christian facist court until the separation is gone
