A waitress is serving a Texas GOP leader. Says “thanks for the tip, it will help pay for my abortion”. Good Samaritans hear about this and sue the GOP leader for aiding in the abortion. Works?"It's as if the Drumpf Administration is made up of the worst and unfunny parts of the Cleveland Browns, Washington Generals, and the alien Mon-Stars from Space Jam."

Your nosy neighbor or the obnoxious protestor isn't a covered entity by HIPAA, so if they somehow get this information and release it... they didn't violate any law. More importantly, it doesn't require actual knowledge of actual abortion. It's as inane as the old witch trials. The accusation is sufficient to cause major problems, and requires the defendant to prove a negative. And more absurdly, even if they do, they are specifically not entitled to court cost reimbursement.I gotta little bit of smoke and a whole lotta wine...

The person reporting it wouldn't be violating HIPAA but wouldn't the State of Texas?
(I freely admit I have no ****ing clue how HIPAA works I am asking out of ignorance)
edit: asked my gf (she deals with HIPAA) and she seems to think a case could be made for it but the research she did doesn't seem to specify it either way and the wording is vague.Last edited by Handyman; 09-02-2021, 03:31 PM."It's as if the Drumpf Administration is made up of the worst and unfunny parts of the Cleveland Browns, Washington Generals, and the alien Mon-Stars from Space Jam."
