Ha, well the spotters will also be suing the drivers since that was clearly spelled out as abetting the crime

A waitress is serving a Texas GOP leader. Says “thanks for the tip, it will help pay for my abortion”. Good Samaritans hear about this and sue the GOP leader for aiding in the abortion. Works?

Your nosy neighbor or the obnoxious protestor isn't a covered entity by HIPAA, so if they somehow get this information and release it... they didn't violate any law. More importantly, it doesn't require actual knowledge of actual abortion. It's as inane as the old witch trials. The accusation is sufficient to cause major problems, and requires the defendant to prove a negative. And more absurdly, even if they do, they are specifically not entitled to court cost reimbursement.

Sounds like the very kind of law that the Supreme Court of the United States should let stand via Shadow Docket.

There hasn’t been a lot of crowing - or reaction at all- from a lot of prominent Rs. I think many of them realize this could really hurt their midterm turnout while you have millions of people who don’t want to live in a stasi state

But the case would be referred to a public court of law. You would be outting them for the record. They would be forced/compelled to discuss it in order to defend themselves.

The person reporting it wouldn't be violating HIPAA but wouldn't the State of Texas?

(I freely admit I have no ****ing clue how HIPAA works I am asking out of ignorance)

edit: asked my gf (she deals with HIPAA) and she seems to think a case could be made for it but the research she did doesn't seem to specify it either way and the wording is vague.

It wouldn't matter. Only "covered entities" are help to the accountability aspect of this, and that ******* who's accusing everyone isn't that.
