Plus I dont see Biden wasting 2 years of full control (if the Senate flips) on something like that. There is a lot that needs fixing and you just never know how long you will have the window.
If SCOTUS starts striking down or weakening prior progressive decisions, then you simply do what you can - ram through legislation to patch the holes while you've got full control of the WH and both houses of Congress, and take the case back to the voters in 2022 and 2024.

      This is entirely naive.

      First, it’s When. Not if.

Second, waiting until a gamble in 2022 after people forgot just how bad dump was and start voting back “reasonable” Republicans is too late. You can tell me you won’t see a “Donald who?” Starting around November 10th, 2020 much less November 1, 2022.

If you’re given a chance to make the changes we need, take it. Don’t give it up to future votes. Voters are dumb and the WH and Senate already have major structural disadvantages for the Dems. Take the landslide and run.

What you've just proposed is what got us the VRA struck down, Obamacare gutted, etc. Politics as a “gentlemen’s game” is DEAD.

        • We're going to pack the Court. We have no choice. And we have finally learned just how short 2 years is.

Biden should announce 6 new SCOTUS nominees in his inauguration speech. Schumer should schedule the confirmation for before the State of the Union.

I want the Court expanded during the current term. When we beat the Nazis their regime ends -- after Germany surrendered we didn't let them gas Jews for another few years because of "norms."

The one and only lesson the GOP taught us over the past 40 years is power doesn't care if you won by 1 point or 50: if you use it it carries full weight, and if you don't use it it carries no weight. A mandate is the legal ability to act; nothing more.

The second we have the keys we have to drive the car out from in front of the on-rushing truck. Waiting and whining about institutional integrity is no help for the people trapped inside.

          • Breaking: Republican U.S. Senate candidate Jason Lewis will self-quarantine and get tested again for COVID-19 after exposure this week to a person who tested positive on Wednesday.

Lewis has been a harsh critic of forced business closures and other state-imposed limits in response to the pandemic. He has also flouted social distancing guidelines at campaign events.

Pack the Court find but expand it? Bad optics. The pendulum always, always eventually swings back.

And yet that never stops the GOP from being craven and defying all norms.

Put another way, I abhor the DH, but I'm not stupid enough to suggest the Cubs not use it when allowed.

                    1. Packing the court means expanding the court.

                    2. Optics means nothing. It is another of the too smart by half ideas we picked up in our education about soft power and institutional norms. Those things are only meaningful when both sides observe them. But when fighting Nazis you do everything you can that is legal. Being sweet and polite only harms the people who are at risk. We can afford that because we will survive, but we do people great harm if we sacrifice their actual lives on the altar of our cutesy little theoretical clean fingernail scruples.

                    3. If the pendulum swings back the Nazis will do whatever they want, regardless of what we do now. Legal or illegal. Performative, procedural, or murderous. There is no deterrence. There is no MAD. There is only now and what we do with our power now. If we do no good we are no good.

The Nazis taught us what power is, and for that we should thank them. The Nazis then used that power for malignant ends. We will now use it for good ends, and the first good end we will pursue is destroying their ability to ever regain majorities. That means completely undoing their 40-year assault on everything this nation cares about. No more grad school masturbation about principles. We now understand what needs to be done, concretely, in law, and then in execution of that law. No points for excuses; no bonus for theoretical finesse. Just. Do. It. Own it. When we do good for the country we will be re-elected. When we prevaricate and delay and concede ground to our donors and the amoral advisors who tell us what is politically expedient, we will not.

                    • Sociopathy. It's what's for dinner.

Rep. Doug Lamborn is the latest Republican to be busted showing total disregard for the health of everyone around him as COVID-19 spreads through the upper ranks of his party. ... First off, Lamborn has kept his staff in the office even as many other members of Congress have shifted to remote work. Next, Lamborn’s deputy chief of staff—who is also his legislative director—and his military legislative assistant have both tested positive for the coronavirus—but Lamborn won’t get tested.

Lamborn is home in his Colorado district attending fundraisers, including one for a Republican congressional candidate who told reporters that Lamborn claimed to have had little interaction with a staffer who tested positive. Considering we’re talking about his deputy chief of staff/legislative director, that seems either questionable as a claim or irresponsible as a lawmaker. But it gets better.

The chief of staff called and told us about the one positive case,” one source told The Denver Post, and another confirmed. “Three or four more people are experiencing symptoms. … It was recommended that they not tell their roommates.”
