          Black Cloud was right when he said they should have been included in talks all along. It shouldn't be a NCAA-UND issue, it should be a UND-tribal issue handled by those 2 parties.

            You forgot to include "racial slurs". The null hypothesis has already been rejected. Since you have a presumptuous habit of personifying all North Dakotans, you should know what that means.

                Does every sioux in the world have to say yes or does just one tribe have to approve? Did all seminole tribes approve of FSU? Why stop there...maybe the vote of the tribes needs to be unanimous?

                  No, just the two tribes mandated by the contract agreement and judgment reached in the 2007 lawsuit settlement between the SBOE and the NCAA. Keep in mind, the settlement agreement of 2007 was merged into a judgment and is not a separate contract, therefore any litigation is ineffectual. Moreover, the Order stipulates that both the State and SBOE relinquished their right to litigation, including filing a Federal antitrust suit. However, Bill 1263 mandates the Fighting Sioux nickname be retained by UND and gives statutory authority to the Attorney General to file an antitrust suit against the NCAA for any such attempt to remove it. This of course is direct violation of the 2007 judgment which was affirmed by the North Dakota Supreme Court in 2009 and essentially usurps the constitutional and statutory authority given to the SBOE to retire the nickname by Nov. 30, 2010. This kind of political intrigue is in direct contravention of the 2007 judgment and is one of the reasons why the Governor, AG, SBOE, UND and the State of North Dakota are currently being sued.

                    I believe the Seminole tribe did approve of FSU using the mascot.

                        This is utter nonsense! The NCAA most certainly recognized Spirit Lake's approval of the nickname. But without the approval of Standing Rock, what would be the point of a few Native American supporters coming to an ill-fated meeting arranged by the ND legislature based upon legislation that is clearly unconstitutional?

                            Of course, they're considered a UND namesake tribe by the NCAA. Although ill conceived, this was one of the points Rep. Carlson tried to use to persuade the NCAA to change their mind.

                            Carlson says he and state and UND leaders did bring everything to the table -- pitching that even though Standing Rock was never going to have a vote, but they were the ones who gave UND the name the first place.

                                It's important to keep in mind, tribal governments and their people are personified and embodied in the leadership of the tribal councils. It is atypical for tribal leadership to have a tribal vote on matters they feel are marginal issues that do not directly affect the welfare and future of the tribes themselves. They do not function with the same democratic philosophy and modality as US state and federal governments. The tribal councils are hegemonic, transcendent and hierarchical, and theoretically embody the will of the people on peripheral matters. That's why Charles Murphy from Standing Rock made statements to the effect that there were other more important issues for the tribal council to consider.

                                Since it is not within the legal jurisdiction of the NCAA to stipulate how distinct tribal governments determine their representative view of the NCAA resolution, they are not liable for whatever tribal process is implemented to express that view.
